This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.   • We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Recipients of personal data

We will not share your personal data with any third party marketing agencies. We may share your information with other affiliated companies within the Manulife group of companies if we have a legitimate interest for doing so.   • service providers, for example custodians, brokers, unit registry services or correspondent banks;

We may share your information with Manulife affiliated companies in non-EEA states. To the extent that your information is shared outside the EEA, we ensure that equivalent protections are in place by implementing at least one of the following safeguards:

  • Your personal data will be transferred to a country that has been deemed to provide an adequate level of protection for personal data by the European Commission.
  • We may enter into a specific contract with the recipient of your personal data which has been approved by the European Commission which gives the personal data the same protection it has in Europe.

General

In the event that any provision of these Global Terms shall, in whole or in part, be determined to be invalid, unenforceable or void for any reason, such determination shall affect only the portion of such provision determined to be invalid, unenforceable or void, and shall not affect in any way the remainder of such provision or any other provision of these Global Terms. Manulife Asset Management and user authorize a court or arbitrator to replace such an invalid, unenforceable or void provision with a valid provision which is as similar as possible in substance to the invalid, unenforceable or void provision. Manulife Asset Management's failure to act with respect to a breach by user or others does not waive their right to act with respect to subsequent or similar breaches.

The laws of the Province of Ontario and the federal laws of Canada applicable therein shall govern as to the interpretation, validity and effect of this agreement and any use of the website, other than the location-specific portions of the website, which shall be governed as indicated therein. You hereby consent and submit to the non-exclusive jurisdiction of the courts of the Province of Ontario in any action or proceeding instituted under or related to this agreement or your use of the website. In the event of any conflict between foreign laws, rules and regulations and those of Canada, the laws, rules and regulations of Canada shall govern.
